NOTICE OF FINDING OF NO SIGNFICANT IMPACT AND NOTICE OF INTENT TO REQUEST RELEASE OF FUNDS

These notices shall satisfy two separate but related procedural requirements for activities to be undertaken by the City of Clarksburg and the Clarksburg-Harrison Regional Housing Authority.

REQUEST FOR RELEASE OF FUNDS

On or about December 1, 2016 the City of Clarksburg will authorize the Clarksburg-Harrison Regional Housing Authority to submit a request to the U.S. Department of Housing and Urban Development (HUD) for the release of Public and Indian Housing (PIH) Project Based Voucher (PBV) funds under Section 8 (o) (13) of the U.S. Housing Act of 1937, as amended, to undertake a project known as The Palace on Main. The project will be an adaptive reuse of an existing structure into 40 affordable housing units for persons 55 and older. It will be financed using LIHTC from WVHDF that will be paired with historic tax credits, in addition to the PBV's. The total estimated project is $5,408,455 in LIHTC Equity plus, $868,335 in Federal Historic Tax Credits plus, $313,565 in State Historic Tax Credits plus $217,560 in Project Based Vouchers totaling $6,807,915. The project is located at 168 W. Main Street, Clarksburg, WV 26301.

FINDING OF NO SIGNIFICANT IMPACT

The City of Clarksburg has determined that the project will have no significant impact on the human environment. Therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required. Additional project information is contained in the Environmental Review Record (ERR) on file at The City of Clarksburg, 222 W. Main Street, 2nd Floor, City Clerk's Office, Clarksburg, WV 26301 or online at http://cityofclarksburgwv.com/econ-dev-home/projectsandupdates/682-palace-on-main. The ERR can also be examined at The Clarksburg-Harrison Regional Housing Authority, 433 Baltimore Avenue, Clarksburg, WV 26301 and may be examined or copied Monday through Friday 9:00 A.M to 3:00 P.M.

PUBLIC COMMENTS

Any individual, group, or agency may submit written comments on the ERR to the City of Clarksburg, Attn: Martin Howe, City Manager, 222 W. Main Street, Clarksburg, WV 26301. All comments received by November 30, 2016 will be considered by The City of Clarksburg prior to authorizing submission of a request for release of funds. Comments should specify which Notice they are addressing.

ENVIRONMENTAL CERTIFICATION

The City of Clarksburg certifies to HUD that Mayor Catherine Goings in her capacity as Mayor of the City of Clarksburg consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. HUD's approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows the Clarksburg-Harrison Regional Housing Authority to use Program funds.

OBJECTIONS TO RELEASE OF FUNDS

HUD will accept objections to its release of fund and the City of Clarksburg's certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of the City of Clarksburg; (b) the City of Clarksburg has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR part 58; (c) the grant recipient or other participants in the development process have committed funds, incurred costs or undertaken activities not authorized by 24 CFR Part 58 before approval of a release of funds by HUD; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58, Sec. 58.76) and shall be addressed to HUD Baltimore Field Office at City Crescent Building, I 0 South Howard Street, 5th Floor Baltimore MD 21201- 2505, Attention PIH Director. Potential objectors should contact HUD at 410-209-6546 to verify the actual last day of the objection period.
